Ice Maven Terms of Service

Welcome to Ice Maven (“Company,” “we,” “us,” or “our”), a provider and distributor of dry ice products. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By using our Services or purchasing our products, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our Services.

1. Services Description

Ice Maven supplies and distributes dry ice for commercial and consumer use. We are committed to safe, compliant, and timely distribution. Our sister company, Spring Reefer, may provide logistics, equipment rental, or delivery services, but all dry ice distribution falls under Ice Maven.

2. Orders and Payment

• All orders are subject to availability and confirmation.
• Prices may change without notice.
• Payment is due at time of delivery unless otherwise agreed in writing.
• We reserve the right to refuse any order or service at our discretion.

3. Delivery and Risk of Loss

• Risk of loss passes to you upon delivery to your location or the carrier.
• We are not responsible for loss due to sublimation or mishandling after delivery.
• All delivery windows are estimates and not guaranteed.
• Issues must be reported within 24 hours of delivery.

4. Product Characteristics and Storage

• Dry ice is perishable and will sublimate (evaporate) at a rate of approximately 5–10% per 24 hours.
• We guarantee the condition of dry ice only at the time of delivery.
• No refunds will be issued for natural sublimation after delivery.
• Proper storage in insulated containers and ventilation is your responsibility.

5. Safety Guidelines

Dry ice is extremely hazardous if not handled correctly. By purchasing from us, you agree that you:

• Understand the risks of handling dry ice (-109.3°F / -78.5°C).
• Will never store it in airtight containers (risk of explosion).
• Will use dry ice only in ventilated areas to prevent asphyxiation.
• Will keep it away from children and pets.
• Will use proper safety gloves and tools when handling.

Failure to follow these guidelines may result in injury, for which we are not liable.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• Ice Maven shall not be liable for indirect, incidental, or consequential damages of any kind.
• Our liability is limited to the amount you paid for the product giving rise to the claim.
• We are not liable for any injuries, property damage, or loss caused by improper handling or storage.

7. Indemnification

You agree to indemnify and hold harmless Ice Maven, Spring Reefer, and their officers, agents, employees, and affiliates from any claims, losses, or damages arising from:

• Your use or misuse of our products,
• Any breach of these Terms,
• Any third-party claims related to your handling, transport, or storage of dry ice.

8. Intellectual Property

All website content, logos, designs, and materials are owned by Ice Maven and protected by copyright and trademark laws. You may not reproduce, copy, or distribute any materials without written permission.

9. Force Majeure

We are not responsible for any delay or failure to perform caused by events beyond our control, including but not limited to:

• Acts of God,
• Transportation delays,
• Governmental actions,
• Power outages,
• Labor disputes,
• Equipment or supply chain failures.

10. No Warranties

Dry ice is sold as-is, with no express or implied warranties, including fitness for a particular purpose. We make no guarantees regarding lifespan, volume retention, or suitability for your specific use.

11. Return Policy

• Due to the perishable nature of dry ice, all sales are final.
• No returns or exchanges will be accepted.
• If there was an error in the quantity or item delivered, please notify us within 24 hours.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Colorado. All disputes shall be handled exclusively in the courts of Colorado.

14. Modifications

We may revise these Terms at any time. Updates are effective upon posting to our website. Your continued use of our Services constitutes acceptance of the modified Terms.

15. Entire Agreement

These Terms represent the full agreement between you and Ice Maven. They supersede any previous oral or written agreements.
